This Privacy Policy applies to your access and use of the Pokapoka Kitchen, LLC website, ordering forms,  versions of our website, and other online programs (“Online Services”)  provided by Pokapoka Kitchen, LLC. (“Pokapoka Kitchen, LLC”, “we”, or “us”) By accessing or using any of the Online Services, you agree that you have read and agree to be bound by this Privacy Policy. If you don't agree, please do not use any of the Online Services.

When you use any of the Online Services, we may collect information about you, and we may share some or all of that information with third parties in certain circumstances. This Privacy Policy will give you more details about such collection, use, and sharing.

Our business is located in San Diego, California, United States. Our online privacy practices are governed by the laws of the United States and the State of California. By using any of the Online Services, you understand and agree that any information you submit or that is gathered about you will be transmitted to, stored in, and subject to the laws of the United States.

This Privacy Policy may be updated and changed from time to time. Please check periodically for changes. See Section 13 for additional details.

1.  INFORMATION WE COLLECT

a. Information You Provide to Us

User Information

Information you provide to access our Online Services, including your name, mailing address, telephone number, e-mail address, and any account credentials.

Business / Organization Information

If you represent a company, clinic, hospital, biotech firm, or other organization placing a catering order, we may collect your organization's name, billing address, invoicing address, contact person name, and job title. This information is used solely to process and fulfill your order and manage our business relationship with your organization.

Order Information

When you submit an order request or confirm an order, we collect details including:

  • Menu items and quantities requested

  • Requested delivery date, time, and location (delivery address or event venue)

  • Headcount and any dietary restrictions or food allergy information

  • Special instructions for delivery, setup, or onsite service

  • Contact person at the delivery or event location

Financial & Payment Information

To process payment for your order, we collect billing information and payment details. All payments are processed through QuickBooks Payments, a third-party payment processor. Pokapoka Kitchen, LLC does not store your full payment card information on our servers. Payment information is transmitted securely via QuickBooks Payments' encrypted payment system. By submitting payment, you authorize Pokapoka Kitchen, LLC to charge the confirmed order total through QuickBooks Payments.

For corporate clients, we may collect company billing address, accounts payable contact, and invoice delivery preferences.

Self-Reported Information

Additional information you may voluntarily provide in order forms, feedback submissions, allergy notifications, or any other interactions with our Online Services.

Demographic Information

Where you choose to provide it, we may collect information about your employment, location, preferences, and interests.

b. Information We Collect Automatically

Service Data

Information about your interactions with the Online Services, such as pages viewed, links clicked, and actions taken during your session.

Device & Log Information

Information about your device including IP address, hardware model, operating system and version, browser type, and aggregated clickstream data such as entry/exit points, page views, and traffic statistics.

Geolocation Information

General location of your device based on IP address. We will request your permission before collecting precise GPS location data.

Cookie Information

Information collected through cookies, web beacons, pixel tags, and similar technologies. See Section 5 for full details.

c. Information Collected from Third Parties

We may receive information about you from third-party payment processors (QuickBooks Payments), analytics providers (Google Analytics), and delivery-related tools used to coordinate your order. We do not purchase or receive personal data from data brokers for marketing purposes.

2.  HOW WE USE YOUR INFORMATION

We use the information we collect for the following purposes:

  • To receive, confirm, process, and fulfill your catering, delivery, pop-up, or onsite service order

  • To send order confirmations, invoices, payment links, and delivery notifications via email

  • To coordinate delivery to your specified location, including providing our delivery staff with your address and contact information

  • To coordinate onsite service (e.g., sushi assembly) at your event venue, including sharing relevant order and access details with our staff

  • To respond to your inquiries, requests, or complaints

  • To send you communications about promotions, new menu items, or other offers from Pokapoka Kitchen, LLC  (you may opt out at any time)

  • To improve our services, analyze usage trends, and evaluate the effectiveness of our operations

  • To detect, prevent, and address fraud, security breaches, and misuse of our Online Services

  • To comply with applicable laws, regulations, and legal obligations

  • To enforce our Terms of Use and other policies

3.  SHARING OF PERSONAL INFORMATION

Except as described in this section, we will not knowingly disclose your Personal Information to anyone outside of Pokapoka Kitchen, LLC.

To Fulfill Our Services

We may share your information with third-party service providers who assist us in operating our business, including:

  • QuickBooks Payments (payment processing)

  • Google Workspace (email communications)

  • Squarespace (website hosting and order forms)

  • Jotform (order form submissions)

  • Make (order processing automation)

  • QuickBooks (accounting and invoice management)

  • Our own delivery staff, who receive only the address, contact name, and order details necessary to complete your delivery

Delivery & Onsite Staff

When you place a delivery or onsite service order, your delivery address, contact name, phone number, and relevant order details will be shared with the Pokapoka Kitchen, LLC staff member handling your order. This information is used solely to complete your order and is not retained by individual staff members beyond the service date.

Corporate Transactions

In connection with a merger, acquisition, sale, or similar corporate transaction, your information may be disclosed to the relevant parties as part of that process.

Legal Compliance

We may disclose your information as required by applicable law, in response to valid legal process, or to protect the rights, property, or safety of Pokapoka Kitchen, LLC our customers, or others.

Third-Party Marketing

We do not sell your personal information. We do not share your personal information with third-party marketing partners without your explicit consent.

4.  NON-PERSONAL INFORMATION

Non-personal information (data that does not identify an individual) may be used for any lawful purpose, including analytics, service improvement, and aggregated reporting. We may collect, compile, store, publish, and use any information that does not identify an individual.

5.  COOKIES, WEB BEACONS, AND ONLINE ADVERTISING

What Are Cookies?

Pokapoka Kitchen, LLC uses small text files called cookies, and similar technologies such as pixel tags, web beacons, and clear GIF files (collectively, “Cookies”). Cookies are small pieces of data placed in your browser to store preferences and track online activity. A Cookie typically contains the domain name it comes from, an expiration date, and a unique identifier.

These allow you to use core features of the Online Services, such as form submissions and session management.

Analytics Cookies

These track how our website is used so we can make improvements. We use Squarespace's built-in analytics for this purpose.

6.  DELIVERY POLICY & INFORMATION

The following terms apply to all delivery orders:

Delivery Area

We currently deliver within the San Diego, California metropolitan area. Delivery availability outside this area is at our discretion and must be confirmed in advance.

Delivery Information We Collect

To fulfill your delivery, we collect and use your delivery address, contact name, phone number, and any specific delivery instructions. This information is shared with the Pokapoka Kitchen, LLC staff member handling your delivery.

Delivery Access

By placing a delivery order, you confirm that Pokapoka Kitchen, LLC staff have permission to access the delivery location (including lobbies, reception areas, or designated drop-off areas) as necessary to complete the delivery.

Delivery Timing

We make reasonable efforts to deliver at the confirmed time. Pokapoka Kitchen, LLC is not liable for delays caused by traffic, weather, road conditions, access restrictions at the delivery location, or other circumstances beyond our reasonable control.

Recipient Availability

You are responsible for ensuring that a designated recipient is available at the delivery location at the confirmed delivery time. If no recipient is available and the delivery cannot be completed safely, we will contact you and make reasonable efforts to complete the delivery. Additional delivery attempts or fees may apply.

Food Quality Upon Delivery

Pokapoka Kitchen, LLC is responsible for food quality up to the point of delivery. Once food has been delivered and accepted, Pokapoka Kitchen, LLC is not responsible for food safety issues arising from improper handling, storage, or serving by the recipient.

7.  ONSITE SERVICE (SUSHI ASSEMBLY & EVENT STAFF)

For onsite service events (including sushi assembly and corporate event catering), the following terms apply:

Venue Access

By booking an onsite service, you confirm that Pokapoka Kitchen, LLC staff have your authorization to access the event venue at the agreed service time to set up, assemble, and serve food. You are responsible for ensuring that venue management or building security is informed of our staff's arrival.

Venue Requirements

You are responsible for ensuring that appropriate space, tables, and basic utilities (e.g., access to a water source if needed) are available at the venue. Pokapoka Kitchen, LLC will not be responsible for delays or service limitations caused by inadequate venue setup.

Food Preparation vs. Assembly

For sushi assembly services, all food is prepared in a licensed commercial kitchen prior to arrival at the event venue. Assembly (plating, arranging, and presenting) is completed on-site. No raw food preparation is conducted on-site.

Staff Conduct

Pokapoka Kitchen, LLC staff will conduct themselves professionally at all times. You agree to provide a safe working environment for our staff at your event venue.

8.  ORDERS, CANCELLATIONS & REFUNDS

Order Process

All orders are subject to Pokapoka Kitchen, LLC's review and confirmation. Submitting an order request does not constitute a confirmed order. An order is confirmed only when you receive written confirmation from Pokapoka Kitchen, LLC via email.

Prepayment

All orders require full prepayment prior to delivery or service. Payment is collected via a QuickBooks payments Invoice or Payment Link sent to your email address. Your order will not be scheduled until payment is received in full.

Cancellations by Client

  • Cancellation 3 business days before the scheduled delivery/service. : Full refund

  • Cancellation less than 48 hours before the scheduled delivery/service: No refund

  • No-show or failure to receive delivery: No refund

Cancellations by Pokapoka Kitchen, LLC

We reserve the right to cancel or modify an order if we are unable to fulfill it due to ingredient availability, kitchen capacity, staffing, or circumstances beyond our control (Force Majeure). In such cases, a full refund will be provided.

Order Modifications

Order modifications (including changes to menu items, quantities, delivery time, or delivery address) may be accommodated, subject to availability. Please note that modification requests cannot always be accepted, particularly if made close to the scheduled delivery or service. Additional charges may apply depending on the nature of the requested changes.

Force Majeure

Pokapoka Kitchen, LLC is not liable for failure to perform any order due to circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, public health emergencies, government restrictions, supply chain disruptions, or other events outside our reasonable control. In such cases, we will make reasonable efforts to reschedule or provide a full refund.

9.  FOOD SAFETY, ALLERGENS & DIETARY RESTRICTIONS

Allergy & Dietary Information

Pokapoka Kitchen, LLC makes reasonable efforts to accommodate allergy and dietary restriction requests submitted at the time of ordering. However, we cannot guarantee that any menu item is completely free from any specific allergen.

Shared Kitchen Cross-Contamination

Pokapoka Kitchen, LLC prepares food in a licensed shared commercial kitchen. This facility may also be used by other food businesses. While we take precautions, we cannot guarantee that our food has not come into contact with common allergens (including but not limited to gluten, tree nuts, peanuts, dairy, soy, eggs, shellfish, and fish) due to shared facility use. Customers with severe food allergies should inform us at the time of ordering and exercise caution.

Allergen Disclaimer

By placing an order, you acknowledge and accept the inherent risk of cross-contamination from shared kitchen use. Pokapoka Kitchen, LLC is not liable for allergic reactions or dietary issues arising from undisclosed allergies or from cross-contamination in the shared kitchen facility.

Natural Food Remnants Disclaimer

While reasonable care is taken during food preparation, Pokapoka Kitchen, LLC cannot guarantee the complete removal of all natural remnants, including but not limited to small fish bones, fish scales, shrimp shells, or shell fragments from shellfish. Customers are advised to exercise caution when consuming these items.

10.  SOCIAL NETWORKING AND THIRD-PARTY SITES

When you interact with our Online Services through any social networking service, any information you supply becomes subject to that network's privacy policy. We are not responsible for the privacy practices of third-party sites or services. Links on our website to other sites are provided for convenience; we are not responsible for the content or privacy practices of those sites.

11.  CALIFORNIA RESIDENTS

a. Marketing

Under California Civil Code Sections 1798.83–1798.84 (the “Shine the Light Law”), California residents with an established business relationship with us may request, once per calendar year and free of charge, information regarding any personal information we disclosed to third parties for their direct marketing purposes during the preceding calendar year, including the categories of personal information disclosed and the names and addresses of those third parties, if applicable.

b. California Consumer Privacy Act (CCPA)

California residents may have certain rights under the California Consumer Privacy Act (CCPA), as amended, including:

  • Right to Delete: You may request deletion of your personal information, subject to certain exceptions.

  • Right to Non-Discrimination: We will not discriminate against you for exercising your rights under the CCPA.

c. Do Not Track Signals

Some web browsers incorporate a "Do Not Track" (DNT) feature that signals to websites that you do not wish to have your online activities tracked. Pokapoka Kitchen, LLC does not track customers across third-party websites for targeted advertising and does not respond to DNT signals. However, third-party services integrated with our website may collect information about your online activities over time and across different websites in accordance with their own privacy policies. 

12.  NEVADA RESIDENTS

Nevada law entitles you to request that we refrain from the sale of your personal information to other entities for purposes of resale. We do not engage in such sales of personal information.

13.  CHILDREN

Our Online Services are not intended for anyone under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have obtained personal information from a child under 18, we will delete that information promptly.

14.  SECURITY

We use reasonable administrative, technical, and physical safeguards to help protect your personal information from unauthorized access, use, disclosure, or modification. However, no system is completely secure, and we cannot guarantee absolute security. In the event of a data breach affecting your information, we will notify you as required by applicable law.

15.  RETENTION OF INFORMATION

We retain personal information only for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including for legal, accounting, tax, and record-keeping purposes. Retention periods may vary depending on the nature of the information and applicable legal requirements.

Upon your request, we will delete your personal information, subject to certain exceptions where we are required or permitted by law to retain it.
